https://kateshela.com, including all content, features, products, services, events, digital materials, courses, webinars, and related offerings (collectively, the “Services”).

By accessing the website, purchasing any product, registering for an event, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

2. Eligibility and User Responsibilities

By using the Services, you represent and warrant that:

  • You are at least 18 years of age (or the age of majority in your jurisdiction); or
  • You have the consent of a parent or legal guardian, where required;
  • You have the legal capacity to enter into binding agreements; and
  • All information you provide is accurate, current, and complete.

 

You agree to use the Services only for lawful purposes and in accordance with these Terms.

We reserve the right to:

4. Products and Services Offered
4.1 In-person Events

We may offer live, in-person events, retreats, workshops, or seminars from time to time. Event details (including date, location, schedule, speakers, and content) may change where reasonably necessary.

Attendance is subject to venue rules, safety requirements, and capacity limits. Attendees are responsible for their own travel, accommodation, and insurance unless otherwise stated.

4.2 Online Courses and Webinars

Online courses and webinars may be delivered live, pre-recorded, or in a blended format. Access periods, inclusions, and any time limitations will be specified at the time of purchase.

We do not guarantee that any course or webinar will achieve a particular outcome for you.

4.3 Digital Products

Digital products (including downloadable documents, templates, recordings, or resources) are provided electronically. Once access is granted or a download occurs, the product is deemed delivered.

5. Pricing, Payments, and Billing

All prices are displayed on the website in the stated currency and are exclusive of applicable taxes (taxes may be added at checkout), unless otherwise specified.

Payment methods accepted include:

  • Credit / debit card; and
  • Stripe.

 

You authorize us (and our third-party payment processors) to charge the applicable fees to your chosen payment method. All payments must be received in full before access to paid Services is granted.

We reserve the right to correct pricing errors and cancel orders where an error has occurred.

6. Refunds and Cancellations

Nothing in these Terms is intended to exclude any rights you may have under applicable consumer laws that cannot be excluded.

For a Cancellation from Kate Shela or Venue

Event dates may change, and any person who has purchased a ticket to the event will be notified as soon as practicable when the change is made clear. If this affects your ability to participate, then the opportunity to receive a credit for your purchase will be extended upon request. 

Participants will be able to transfer their purchase to another participant. Receipt of purchase must be present with the person attending.

Digital products and online content

No refunds are provided once content has been accessed or downloaded, except where required by law.

7. Intellectual Property and License

All content made available through the Services – including text, video, audio, graphics, designs, course materials, and downloadable resources – is owned by The business or its licensors and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access the Services for your personal, non-commercial use only, subject to No – personal use only.

You must not:

  • Reproduce, distribute, modify, or resell content;
  • Share login access;
  • Record live sessions without permission; and

Use content for commercial or competitive purposes.

8. User Accounts and Access

If access to any Service requires an account or login:

  • You are responsible for maintaining the confidentiality of your credentials;
  • You are responsible for all activity under your account; and

We may suspend or terminate access if misuse or unauthorized activity is detected.

9. Disclaimers of Warranties

We do not warrant that:

  • The Services will be uninterrupted or error-free;
  • Content is complete, accurate, or up-to-date; and

Participation will lead to specific results or outcomes.

To the maximum extent permitted by law, we exclude all liability for indirect, incidental, or consequential loss. Our total liability arising out of or in connection with the Services is limited to the amount you paid to us for the relevant product or service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless Kate Shela, its officers, employees, contractors, and affiliates from any claims, losses, damages, or expenses (including legal fees) arising from:

  • Your misuse of the Services;
  • Your breach of these Terms; and

Your violation of any applicable law or third-party rights.

12. Termination and Suspension

We may suspend or terminate your access to the Services at any time if you breach these Terms, misuse the Services, or where continued access would pose legal or operational risk.

We may suspend or terminate your access to the Services at any time, without notice, if:

  • You breach these Terms;
  • You misuse the Services; and
  • Continued access would pose legal or operational risk.

Termination does not affect accrued rights or obligations.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of California, United States, and you submit to the exclusive jurisdiction of the courts of that jurisdiction.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.
